These Terms and Conditions (“Agreement”) are a legally binding contract between you (“you” or “User”) and StudExpress (“StudExpress,” “we,” “us,” or “our”). These terms govern your access to and use of the StudExpress website, mobile applications, technology, services, facilities, and related platforms (collectively, the “StudExpress Platform”).
By accessing or using the StudExpress Platform, you agree to be bound by this Agreement. If you do not agree with any part of this Agreement, you must not use the StudExpress Platform.
1.Eligibility
To use the StudExpress Platform, you must be at least 18 years old and legally capable of entering into binding contracts. Users under 18 may use the Platform only with the permission of a parent or legal guardian and in compliance with applicable laws.StudExpress may refuse access or suspend accounts of any Users who do not meet eligibility requirements.
2.Accounts and Registration
To access certain features, you must create an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity associated with your account.You may not share your account with others or allow unauthorized use by any third party. StudExpress reserves the right to deactivate duplicate, fraudulent, or suspicious accounts.
4.User Conduct
You agree that your use of the StudExpress Platform will be lawful and respectful toward all individuals. You will not:
- Provide false, inaccurate, misleading, or fraudulent information.
- Disrupt, interfere with, or attempt to gain unauthorized access to the Platform.
- Use the Platform to harm, harass, or discriminate against others.
- Attempt to reverse engineer or exploit vulnerabilities in the Platform.
- Bypass or interfere with Platform limitations, security, or access controls.
- StudExpress reserves the right to suspend or terminate accounts for unsafe or prohibited conduct.
5.Transport Providers
Transport providers participating in the StudExpress Platform are independent entities and are responsible for compliance with applicable laws, safety standards, insurance coverage, and operational conduct. StudExpress does not directly employ transport providers nor guarantee service quality.StudExpress may request provider documentation for identity, licensing, insurance, and safety verification. Users who act as providers represent that they meet all such requirements.
6.Safety and Monitoring
StudExpress is committed to the safety and security of its users. StudExpress and its partners may use cameras, CCTV, or other monitoring systems in certain environments, vehicles, or facilities where permitted by law to investigate safety incidents, improve service quality, and support dispute resolution.You consent to such safety monitoring in accordance with applicable laws.
7.Intellectual Property
All content, trademarks, logos, designs, software, and technology used on the StudExpress Platform (“StudExpress IP”) are the property of StudExpress or its licensors and are protected by copyright, trademark, and other intellectual property laws.You may not copy, modify, reproduce, distribute, or create derivative works from StudExpress IP without express written permission.
8.Dispute Resolution and Arbitration
By using the StudExpress Platform, you agree that most disputes will be resolved through binding arbitration rather than in court, except where prohibited by law.This means you waive your right to a jury trial and class action proceedings. StudExpress will provide information on how to opt out of arbitration where applicable and permitted.
9.Limitation of Liability
The StudExpress Platform and services are provided “as is” and “as available” without warranties of any kind, whether express or implied. StudExpress is not responsible for third-party actions, provider conduct, delays, errors, or failures in service delivery.StudExpress will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform.
10.Privacy and Data Protection
StudExpress collects, processes, and stores personal information in accordance with our Privacy Policy, which is incorporated into this Agreement by reference. Your use of the Platform signifies your consent to the collection and use of information as described in the Privacy Policy.
11.Modifications to Agreement
StudExpress reserves the right to modify or update this Agreement at any time. Changes will be effective when posted on the Platform. Continued use of the Platform after changes are made indicates your acceptance of the updated terms.
12.Governing Law
This Agreement is governed by the laws applicable where StudExpress operates and where required by local legal frameworks. Any disputes arising under this Agreement will be resolved in accordance with the dispute resolution provisions above.
